Disclosure Exemptions

Having carefully considered the matter, the Council has determined that some details of our IT systems are exempt from disclosure under the following provisions of the Freedom of Information Act 2000. The exemption has been applied where an * is shown.
 

Section 31 -  Law enforcement.

(1) Information which is not exempt information by virtue of section 30 is exempt information if its disclosure under this Act would, or would be likely to, prejudice—
(a) the prevention or detection of crime,

We consider that the disclosure of this information into the public domain could be used in conjunction with other information already available to increase the chances of a successful cyber-attack against the authority.

As this is a qualified exemption we are obliged to carry out a public interest test.

Whilst members of the public are entitled to know what systems the Council purchases using public funds, the Council needs to ensure the integrity of its systems is not compromised. Given the personal and sensitive nature of the data held in our systems and the benefit knowledge of the specific systems would have to an attacker, it is not in the public interest to disclose the information.” Divulging information about our systems setup may facilitate a crafted attack. Knowledge of the specifics of systems (e.g. which O/S is being used; makes and models of firewalls etc.) simplifies the task of an attacker and allows that person to tailor their attack method to suit the potential vulnerabilities of that particular system. On balance we consider that the public interest in the protection of personal data outweighs the public interest in disclosure, therefore this information is exempt under Section 31(1)(a).

Key objectives and challenges for 2023/24

  • Alignment of ICT enabling functions to meet the corporate strategy, working alongside departments and services.
  • Continued development of the Council Digital maturity embedding Microsoft M365 and its enabling functions to improve the experience of both the service user and council staff member.
  • Digital solutions, interoperability of solutions to remove labour intensive functions or unnecessary cost including paper based working
  • Continuation of infrastructure enhancements, including deployment of replacement MFDs, upgrading of a further 92 servers to meet 3rd party roadmaps, replacement of aging network and supporting infrastructure. 
  • Cyber Security - Creation of a roadmap to achieve Cyber Essentials Plus aligning the Council to expected accreditations in support of audits and national submissions. Carry out a full Disaster Test, tabletop and event, output: Council and staff improvement plans.
  • Complete migration of all legacy system, in place maintenance agreements, identified system owners.
  • Centralised contract management for all system-based services, eradication of unsupported systems and associated risks.
  • Migration of the IG function to the IT Lead aligning to standards to meeting national obligations
  • Collaboration with partners to standardise, simply and align services to meet best practices to enhance the Council and the services it provides. Establish TMBC as an attractive technical partner to work with or seek services from.
