The dwelling has been taken into possession by a mortgage lender.

The mortgagee in relation to a mortgage is the provider of the loan (normally a financial institution), who has granted a mortgage on the property as security. The mortgagor is the person who has been granted the mortgage on their property in return for receiving the loan. Where there is default on repayment of the loan, the mortgage deed usually provides for the mortgagee to take possession of the property, and the property may subsequently be sold to repay the outstanding loan. Possession by a mortgagee does not constitute a change of ownership, but if the dwelling is already unoccupied, exemption applies from the date that the mortgagee takes possession under the mortgage. If the property is still occupied when the mortgagee takes possession, the exemption does not commence until the dwelling is vacated by the occupants. Exemption continues until either possession is relinquished or the property is sold.
